1. Acceptance of Terms

By accessing or using DriveKey ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

DriveKey is a subscription platform that connects content creators with subscribers through automated Google Drive access management and cryptocurrency payment processing. Our Platform:

• Enables creators to monetize content through subscription tiers
• Accepts USDC cryptocurrency payments on Polygon, Ethereum, and BSC networks
• Automates Google Drive folder access based on subscription status
• Supports time-limited subscriptions (7-365 days)
• Allows creators to set their own pricing and access duration

3. User Accounts

3.1 Eligibility

You must be at least 18 years old to use DriveKey. By using the Platform, you represent that you meet this age requirement.

3.2 Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Creator Terms

4.1 Creator Responsibilities

As a creator, you agree to:

• Provide a valid cryptocurrency wallet address for receiving payments
• Provide legitimate content that you own or have rights to distribute
• Comply with all applicable laws and third-party terms of service
• Set fair and accurate pricing for your subscription tiers
• Honor subscriptions and provide access as promised
• Not engage in fraudulent, misleading, or illegal activities

4.2 Payment Processing

Creators receive payments directly to their cryptocurrency wallet. This means:

• Payments are sent directly to your wallet address
• DriveKey does not hold or process your funds
• You are responsible for applicable taxes and financial reporting
• You must ensure your wallet address is correct - lost funds cannot be recovered

4.3 No Platform Fees

DriveKey does not charge platform fees. You receive 100% of subscription payments directly to your wallet. You are only responsible for standard blockchain transaction fees.

4.4 Content Ownership

You retain full ownership of your content. DriveKey does not claim any ownership rights. You grant us a limited license to facilitate access management for your subscribers.

5. Subscriber Terms

5.1 Subscriber Responsibilities

As a subscriber, you agree to:

• Provide valid payment information
• Pay subscription fees as agreed
• Use content only for personal, non-commercial purposes
• Not share, redistribute, or resell creator content
• Respect creator intellectual property rights
• Comply with Google Drive Terms of Service

5.2 Payments and Billing

• Subscriptions are time-limited (duration set by creator)
• Payments are one-time cryptocurrency transactions
• All payments are processed via USDC on supported blockchains
• Access expires automatically at the end of the subscription period
• To maintain access, you must purchase a new subscription before expiry

5.3 No Refunds Policy

• All cryptocurrency payments are final and non-refundable
• Blockchain transactions cannot be reversed
• DriveKey cannot process refunds - payments go directly to creators
• Contact the creator directly for any access issues
• Ensure you are purchasing the correct subscription before sending payment

5.4 Access to Content

Access to creator content is granted via Google Drive and is contingent on maintaining an active subscription. Access will be revoked upon subscription expiration or cancellation.

6. Content Policies

6.1 Permitted Content

DriveKey allows creators to monetize legal adult content, including but not limited to consensual adult material, artistic nudity, and other age-restricted content. All content must:

• Be created and distributed legally
• Feature only participants who are 18 years or older
• Be consensually created with all participants' knowledge and permission
• Comply with all applicable laws in your jurisdiction

6.2 Strictly Prohibited Content

The following types of content are absolutely forbidden:

• Child sexual abuse material (CSAM) or any content involving minors
• Non-consensual content (revenge porn, hidden camera, etc.)
• Content depicting or promoting violence, torture, or harm to individuals
• Content involving animals (bestiality)
• Content depicting incest or promoting incestuous relationships
• Content stolen or distributed without the creator's permission
• Content that violates intellectual property or copyright laws
• Hate speech, harassment, or content promoting violence against protected groups

6.3 Platform Behavior

You may not:

• Use the Platform for illegal purposes
• Violate any third-party terms of service (Google, ZPayNow, etc.)
• Distribute malware, viruses, or harmful content
• Attempt to hack, compromise, or disrupt the Platform
• Impersonate others or provide false information
• Engage in fraudulent payment activities or chargebacks
• Scrape, harvest, or collect user data without permission
• Share, resell, or redistribute creator content without authorization

6.4 Enforcement

We reserve the right to remove content and terminate accounts that violate these policies. Illegal content will be reported to law enforcement. We may cooperate with legal authorities as required by law.

7. Intellectual Property

7.1 Platform Rights

DriveKey and its logos, trademarks, and service marks are our property. You may not use them without our written permission.

7.2 Creator Content

Creators retain all rights to their content. Subscribers receive a limited, non-exclusive, non-transferable license to access content for personal use only.

7.3 DMCA Compliance

We respect intellectual property rights. If you believe content on our Platform infringes your copyright, please contact us with a DMCA takedown notice.

8. Disclaimers and Limitations of Liability

8.1 Platform "As Is"

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.

8.2 Third-Party Services

We rely on third-party services (NOWPayments, Google, Clerk). We are not responsible for their failures, outages, or changes to their services.

8.3 Creator Content

We are not responsible for creator content quality, accuracy, legality, or availability. Disputes regarding content should be resolved directly with the creator.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVEKEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

9. Indemnification

You agree to indemnify and hold DriveKey harmless from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or share

10. Third-Party Service Compliance

By using DriveKey, you also agree to comply with:

• Google Terms of Service and Google Drive Terms
• Clerk Terms of Service
• Applicable blockchain network terms and policies

We are committed to operating within all third-party terms of service and expect our users to do the same. Users are responsible for their own cryptocurrency wallet security and transactions.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law principles.

11.2 Arbitration

Any disputes arising from these Terms or use of the Platform will be resolved through binding arbitration, except where prohibited by law.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
